We operate this website and provide private car tour services, airport transfers, and related transportation and tourism services across Sicily (the "Services"). Our website is powered by Shopify, which enables us to offer the Services to you.

The following terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least 18 years of age. If you are booking on behalf of other persons, including minors, you represent that you are duly authorized to do so and that all persons included in the booking are aware of and agree to these Terms.

To use the Services, including browsing our website or booking any of the tours or transfers we offer, you may be asked to provide certain information, such as your name, email address, phone number, pickup location, and payment details. You represent and warrant that all information you provide is correct, current, and complete.

You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 - OUR SERVICES

Rosato Luxury Sicily Tours provides private car tours, airport transfers, and related transportation services across Sicily. All services are carried out with private vehicles and professional drivers.

We make every effort to provide accurate descriptions of our tours, itineraries, and transfers on our website. However, please note that the actual experience may vary due to factors beyond our control, including but not limited to weather conditions, traffic, road closures, seasonal variations, site accessibility, and local regulations. We reserve the right to modify itineraries, routes, or stops when necessary to ensure your safety or due to circumstances beyond our control.

Optional extras, such as certified local guides, are available upon request and subject to availability. Any additional services not included in the original booking may incur extra charges.

All descriptions of services are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any service at any time.

SECTION 3 - BOOKINGS AND PAYMENTS

When you place a booking, you are making an offer to purchase a service. Rosato Luxury Sicily Tours reserves the right to accept or decline your booking at its discretion. Your booking is not confirmed until we send you a written confirmation (via email or other electronic communication).

Deposit and Payment Structure:

All bookings require a non-refundable reservation deposit of 20% plus a service fee of 3%, both based on the total service price at the time of reservation. The remaining 80% is due upon completion of the service and may be paid in cash, by card, or by any other method agreed upon at the time of booking.

If the deposit is not received within the timeframe specified in the booking confirmation, we reserve the right to cancel the reservation without further notice.

Your bookings are subject to cancellation and refund solely in accordance with our Cancellation and Refund Policy [LINK].

SECTION 4 - PRICES AND ADDITIONAL COSTS

Prices, discounts, and promotions are subject to change without notice. The price charged for a service will be the price in effect at the time the booking is confirmed and will be set out in your booking confirmation.

Unless otherwise expressly stated, posted prices include the private vehicle and driver. The following are not included unless specifically stated in the booking:

Entrance fees to monuments, museums, archaeological sites, or other attractions
Certified local guide fees
Meals, drinks, and refreshments
Tolls, parking fees, and ferry crossings
Gratuities
Any other personal expenses

We may offer promotions from time to time that may affect pricing and that are governed by terms separate from these Terms. If there is a conflict between the terms of a promotion and these Terms, the promotion terms will govern.

You agree to provide current, complete, and accurate payment information for all bookings. You represent and warrant that you are duly authorized to use the payment method provided and that all charges will be honored.

SECTION 5 - SERVICE DELIVERY

Pickup and Timing

We will confirm the pickup time, location, and any relevant details prior to the scheduled service. It is your responsibility to be at the agreed pickup point at the agreed time.

If you are not present at the pickup location within 30 minutes of the scheduled time without prior notice, the service may be considered a no-show. In such cases, the deposit will not be refunded and the remaining balance may still be due in full.

Client Delays and Modifications

If you are running late, please contact us as soon as possible. We will make reasonable efforts to accommodate delays, but significant delays may result in a shortened itinerary or modified route to respect the driver's schedule and other commitments.

Requests to modify the itinerary during the tour are welcome and will be accommodated where possible, but are subject to feasibility, time constraints, and may incur additional charges.

Force Majeure

We shall not be held liable for any failure or delay in performing the Services caused by circumstances beyond our reasonable control, including but not limited to severe weather conditions, natural disasters, strikes, road closures, government restrictions, pandemics, or other events of force majeure. In such cases, we will make reasonable efforts to offer an alternative date or a modified itinerary. If the service cannot be provided at all due to force majeure, you will be entitled to a full refund of any amounts paid.

SECTION 6 - CANCELLATIONS AND REFUNDS

All cancellations and refunds are governed by our Cancellation and Refund Policy [LINK], which forms an integral part of these Terms of Service.

Summary:

More than 14 days before the scheduled service: Full refund of the deposit.
Between 7 and 14 days before the scheduled service: 50% of the deposit refunded.
Less than 7 days before the scheduled service or no-show: Deposit is non-refundable.

Rescheduling requests must be made at least 7 days before the original service date and are subject to availability.

SECTION 7 - YOUR RESPONSIBILITIES

By using our Services, you agree to:

Behave respectfully toward the driver and any other staff at all times.
Comply with all applicable local laws and regulations during the service.
Wear seatbelts at all times while the vehicle is in motion.
Not smoke, consume alcohol excessively, or use illegal substances inside the vehicle.
Not damage, soil, or misuse the vehicle or its contents.
Ensure that minors under your care are supervised at all times.

You shall be liable for any damage caused to the vehicle or its contents by you or any member of your party during the service. Rosato Luxury Sicily Tours reserves the right to charge you for repair or cleaning costs incurred as a result of such damage.

We reserve the right to terminate a service in progress, without refund, if you or any member of your party behaves in a manner that the driver reasonably considers threatening, abusive, dangerous, or in violation of these Terms.

SECTION 8 - INTELLECTUAL PROPERTY

Our Services, including but not limited to all trademarks, text, images, graphics, video, audio, and the design and arrangement thereof, are owned by Rosato Luxury Sicily Tours or its licensors and are protected by applicable Italian, European Union, and international intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, or transmit any material from the Services without our prior written consent.

Rosato Luxury Sicily Tours's names, logos, and service names are trademarks of Rosato Luxury Sicily Tours. Shopify's name, logo, and service names are trademarks of Shopify. All other trademarks on the Services are the property of their respective owners.

SECTION 9 - OPTIONAL TOOLS AND THIRD-PARTY SERVICES

You may be provided with access to tools or services offered by third parties as part of the Services, which we neither monitor nor control.

You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties or endorsement. We shall have no liability arising from your use of optional third-party tools.

We may, in the future, offer new features through the Services. Such new features shall be subject to these Terms.

The Services may contain hyperlinks to websites operated by third parties. We are not responsible for the content, accuracy, or practices of any third-party websites. Accessing third-party sites is at your own risk.

We are not liable for any harm or damages related to your use of third-party websites or services. Please review the third party's policies before engaging in any transaction.

SECTION 11 - RELATIONSHIP WITH SHOPIFY

Rosato Luxury Sicily Tours is powered by Shopify, which enables us to provide the Services to you. However, all bookings and transactions are made directly with Rosato Luxury Sicily Tours. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of the services provided by Rosato Luxury Sicily Tours. You hereby release Shopify and its affiliates from all claims, damages, and liabilities arising from your bookings and transactions with us.

SECTION 12 - PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy [LINK] and, where applicable, Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these privacy policies.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services. SECTION 13 - FEEDBACK AND REVIEWS

If you submit any ideas, suggestions, feedback, reviews, or other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any purpose, including commercial use.

You represent and warrant that you own all necessary rights to your Feedback and that it does not violate any third-party rights or applicable laws. We are under no obligation to maintain Feedback in confidence, compensate you for it, or respond to it.

Occasionally, information on or in the Services may contain typographical errors, inaccuracies, or omissions relating to service descriptions, pricing, availability, or itineraries. We reserve the right to correct any errors and to change or update information at any time without prior notice, including after you have submitted a booking.

SECTION 15 - PROHIBITED USES

You may access and use the Services for lawful purposes only. You may not use the Services to: (a) engage in any unlawful activity; (b) violate any applicable Italian, European Union, or international law or regulation; (c) infringe upon our intellectual property rights or those of others; (d) harass, abuse, defame, or harm any person, including our employees and drivers; (e) transmit false or misleading information; (f) upload or transmit viruses or malicious code; (g) collect personal information of others without consent; (h) interfere with the functionality or security of the Services; or (i) engage in any conduct that may harm Rosato Luxury Sicily Tours, Shopify, or other users.

We reserve the right to suspend or terminate your access at any time, without notice, if we determine you have violated these Terms.

SECTION 16 - TERMINATION

We may terminate this agreement or your access to the Services at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.

The following sections survive termination: Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and any other provisions that by their nature should survive.

EXCEPT AS EXPRESSLY STATED BY ROSATO LUXURY SICILY TOURS, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. TO THE EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING THE ITALIAN CONSUMER CODE (D.LGS. 206/2005), THE ABOVE DISCLAIMERS APPLY.

SECTION 18 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ROSATO LUXURY SICILY TOURS, ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICES OR ANY SERVICES PROCURED THROUGH THE SERVICES.

NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER ITALIAN LAW.

SECTION 19 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Rosato Luxury Sicily Tours, Shopify, and their respective affiliates, officers, directors, employees, and agents from any losses, damages, liabilities, or claims, including reasonable legal fees, arising out of: (1) your breach of these Terms; (2) your violation of any law or third-party rights; or (3) your access to and use of the Services.

SECTION 20 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall be enforced to the fullest extent permitted by applicable law, and the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy and Cancellation and Refund Policy, constitute the entire agreement between you and Rosato Luxury Sicily Tours and supersede any prior agreements or communications regarding the Services.

SECTION 22 - ASSIGNMENT

You may not transfer or assign these Terms or any of your rights or obligations without our prior written consent. We may transfer, assign, or delegate these Terms without notice to you.

SECTION 23 - GOVERNING LAW AND JURISDICTION

These Terms of Service shall be governed by and construed in accordance with the laws of the Italian Republic and applicable European Union regulations, including but not limited to the Italian Consumer Code (Decreto Legislativo 6 settembre 2005, n. 206).

For any disputes arising from or relating to these Terms or the Services, the competent court shall be the Court of Palermo, Italy, unless otherwise required by mandatory consumer protection laws that grant jurisdiction to the court of the consumer's place of residence.

SECTION 24 - CONSUMER RIGHTS

Nothing in these Terms shall affect your statutory rights as a consumer under Italian and European Union law, including but not limited to the rights provided by the Italian Consumer Code (D.Lgs. 206/2005) and Directive 2011/83/EU on consumer rights.

In accordance with Article 59 of the Italian Consumer Code, the right of withdrawal does not apply to contracts for the provision of transport services or leisure activities where the contract provides for a specific date or period of performance. Where the right of withdrawal does apply, you may exercise it within 14 days of the booking date, provided the service has not yet been performed.

SECTION 25 - CHANGES TO TERMS OF SERVICE

We reserve the right to update, change, or replace any part of these Terms by posting updates on our website. Material changes will be communicated in accordance with applicable law. Your continued use of the Services after any changes constitutes acceptance of the revised Terms.
